ONE. ORGANISING ENTITY, PURPOSE, TIMEFRAME, TERRITORY AND PARTICIPANTS
The organising entity is OUIGO ESPAÑA, S.A.U. (hereinafter, “OUIGO”), with registered office at Calle Alfonso XII no. 62, 28014-Madrid and holder of Tax ID (N.I.F.) no. A-88269972
The Prize Draw will be national in scope (hereinafter, the “Prize Draw ”) and will be held among participants in the vote for the winner of the second prize in the “OUIGO PRIDE 2025 SHORT FILMS” competition organised by OUIGO ESPAÑA, S.A.U. (hereinafter, the “Voting”) who meet the conditions set out in these terms and conditions. Voting will begin on 16 June 2025 and the participation period will be seven (7) days, that is, until 22 June inclusive. Voting will be accessed via the EasyPromos voting platform (https://www.easypromosapp.com/).
If, for reasons beyond OUIGO’s control, it is necessary to amend, extend or repeat the Prize Draw , this will be communicated to participants by email.
Participation in the Prize Draw is completely free of charge.
TWO . ELIGIBILITY TO PARTICIPATE
All individuals over the age of 18 who are legally resident in Spain may participate in the Prize Draw (hereinafter, the “Participant” or the “Participants”). The owners of the email address provided when registering on the EasyPromos platform and who participate in the Voting will be automatically included in the Prize Draw. If any participant in the Prize Draw does not wish to take part in the Prize Draw, they must notify OUIGO before the date on which it takes place.
OUIGO employees, employees of companies involved in the organisation of the Prize Draw, their second-degree relatives, minors under the age of 18 and individuals not resident in Spain are not eligible to participate in the Prize Draw.
In the event that any of the individuals excluded from taking part are selected as winners, they will forfeit their right to receive the prize, which will be awarded to the next person who meets the valid participation requirements and is designated as a substitute.
OUIGO is not responsible for any incident that may prevent participation in the Voting and/or the Prize Draw. Likewise, the organiser will not provide data connectivity services and accepts no responsibility for any issues with network providers that may prevent participation.
THREE. PARTICIPATION MECHANICS
In order to take part in this Prize Draw , in addition to meeting the above requirements, the process below must be followed:
The Prize Draw will be announced through OUIGO’s official channels (social media, website, newsletter) on 16 June 2025, where details of how to take part and the prizes on offer will be shared.
Users who wish to participate must access the page set up by OUIGO on EasyPromos (https://www.easypromosapp.com/) and vote for the short film of their choice from among those published there, providing the necessary contact details to receive notification should they be selected as winners. To participate in the competition and access the voting system, users will be asked to identify themselves by either providing a valid email address or logging in with their Google account. The purpose of this verification process is to ensure that each user can cast only one vote, either through the email provided to the platform or via their Google profile.
The Prize Draw will be conducted by anonymising the data of all participants who meet the above requirements and selecting ten (10) of them at random . The Prize Draw will be held no later than three (3 ) calendar days after the Voting period ends . OUIGO reserves the right to change the draw date for justified reasons. Each winner will be contacted via the email address provided when registering to participate in the Voting via EasyPromos and will receive one (1) double invitation, valid for two (2) people, to attend the OUIGO PRIDE 2025 Short Film Gala, which will take place on 26 June 2025 at Cinesa Proyecciones (Calle de Fuencarral, 136, Chamberí, 28010 Madrid) (the “Event”).
Only one entry per person will be accepted and no more than one (1) double invitation will be awarded per email address.
Participation will only be deemed valid if the Participant has fully complied with all the requirements set out in these terms and conditions.
Without prejudice to the right to cancel the Prize Draw in the event of force majeure or circumstances beyond its control, OUIGO may replace the aforementioned prizes with others of equal or greater value/features for justified reasons. Prizes may not be exchanged for cash or for other goods or services. The direct or indirect commercialisation and/or sale of the prize by any means is strictly prohibited.
Once the Voting period , has concluded, from 23 June 2025 onwards, OUIGO will contact the ten (10) selected Participants, who will be considered the Winners, using the same method used for entry. If any of the Winners declines the prize or fails to meet the conditions set out in these terms and conditions, alternates will be contacted in the same manner. If necessary, the prize may be declared void. By entering the Prize Draw, participants authorise OUIGO and EasyPromos to contact them via email in the event that they are selected as Winners. No other communications will be made unless necessary to fulfil a different purpose and provided that there is an adequate legal basis for doing so.
FOUR. PRIZES
The prizes offered under this Prize Draw are as follows:
- Ten (10) two-person invitations to attend the Event (hereinafter, the “Prizes”).
Each Prize consists of one invitation valid for two (2) people, at no cost to the Winner.
The Prizes are personal and non-transferable and may not be exchanged, altered, compensated financially, transferred or exchanged for cash or any other goods or services, either in whole or in part.
Likewise, the commercialisation, distribution, transfer or resale of the Prizes, directly or indirectly, by any means or channel, is strictly prohibited.
FIVE. FRAUD
If OUIGO or any entity professionally linked t o this Prize Draw detects any irregularity or suspects that a Participant is hindering the normal development of th e Prize Draw , altering their registration or participation, using any technical or digital means to manipulate their entry, they may unilaterally remove that Participant’s registration. To this end, OUIGO has implemented the necessary technological tools to detect any fraudulent, irregular or malicious conduct aimed at unlawfully obtaining a Prize. OUIGO therefore reserves the right to remove from the register any Participant who is found to have acted improperly or is suspected of engaging in such conduct.
SIX. CLAIMS
The claim period for th e Prize Draw ends one (1) month after the date on which the Prize Draw is held .
SEVEN. ACCEPTANCE OF THE TERMS AND CONDITIONS
By participating in t he Prize Draw , Participants accept these terms and conditions (available at https://www.ouigo.com/es/bases-legales-sorteo-gala-cortometrajes) and OUIGO’s decisions with regard to the resolution of any issue arising from th e Prize Draw .
EIGHT. DATA PROCESSING
In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (General Data Protection Regulation), and with Organic Law 3/2018 of 5 December on Data Protection and the Guarantee of Digital Rights (LOPDGDD), OUIGO ESPAÑA, S.A.U. informs Participants that their personal data will be processed to manage and conduct the Prize Draw, including verification of compliance with the terms and conditions, selection of Winners and prize delivery, where applicable.
Participants declare and guarantee that all personal data provided to OUIGO are truthful, accurate, up to date and correspond to their identity.
Data processing is based on the performance of the promotional relationship established with OUIGO and is necessary for registering and participating in the Prize Draw, as well as for the delivery of prizes to winners. The provision of personal data is required for the purposes stated above. Any objection by the Participant to this processing will prevent their participation in the Prize Draw, as the processing of data is a necessary requirement.
Participants may exercise their rights of access, rectification, erasure, objection, portability and restriction of processing under the GDPR (EU) 216/679 and LOPDGDD by emailing their request to datos@ouigo.es with the subject “Data protection” or by sending a written request to the OUIGO ESPAÑA, S.A.U. address provided above, for the attention of datos@ouigo.es.
The data retention period for the Winners will be limited to the time necessary for the prize validation and delivery process, and, where applicable, to comply with the time limit regarding legal tax obligations.
OUIGO will implement the necessary technical and organisational measures to ensure the security and confidentiality of the personal data of Participants, protecting them from unauthorised or unlawful processing and accidental loss, destruction or damage in accordance with Article 32 of the GDPR.
Once these purposes have been fulfilled, the data will only be kept for the period necessary for the organiser to exercise its right of defence in the event that it exercises or is subject to a claim for any type of liability arising from your participation in the Prize Draw. This period will correspond to the limitation period for any actions and obligations deriving from the relationship between you and the organiser. If you are not satisfied, you may lodge a complaint with the Spanish Data Protection Agency.
NINE. ADMINISTRATION OF TH E PRIZE DRAW THROUGH THE EASYPROMOS PLATFORM
The EasyPromos platform does not sponsor, endorse or manage this Prize Draw , in any way, nor is it associated with i t . The information provided by users during their participation in the Prize Draw is provided to OUIGO and not to EasyPromos. The information provided will be used as set out in these terms and conditions.
TEN. LIABILITY
OUIGO shall not be held liable for delays, losses or damages due to causes beyond its control. OUIGO shall also not be responsible for force majeure events or circumstances beyond its control that may prevent the Winner from enjoying the Prize in full or in part. OUIGO is exempt from any liability in the event of force majeure or circumstances beyond its control, as well as from any damages that may arise during enjoyment of the Prize.
OUIGO accepts no liability whatsoever for any damages of any kind that may arise from the temporary unavailability or interruption of the social media platform used to take part in the Prize Draw , telephone networks or from unmet expectations regarding their use. This applies in particular, though not exclusively, to failures in accessing the various pages and sending participation responses through the EasyPromos platform used fo r this Prize Draw .
OUIGO is exempt from any liability for malfunctions in electronic communication networks that prevent the normal running of the Prize Draw due to causes beyond OUIGO’s control, especially external acts carried out in bad faith.
OUIGO shall not be held liable for transmission problems or data loss not attributable to it.
ELEVEN. TAXATION
The prizes awarded in the Prize Draw will be subject to the provisions of Law 35/2006 of 28 November, which governs Personal Income Tax and partially amends the laws on Corporation Tax, Non-Resident Income Tax and Wealth Tax; Royal Decree 2004/2009, which amends its implementing regulations; Royal Decree 1003/2014 of 5 December; and the tax developments introduced by Royal Decree 633/2015 of 10 July. Also applicable are Transitional Provisions One and Three of Law 13/2011 of 27 May on the Regulation of Gambling; the First Additional Provision of Law 25/2009 of 22 December, which amends various laws to align them with the Law on Free Access to and Exercise of Service Activities; and paragraph 6 and paragraph 7(12) of Article 48 of Law 13/2011 of 27 May on the Regulation of Gambling. Order EHA/388/2010 of 19 February, which approves the tax on betting and random combinations and its self-assessment, sets out the place and method of submission, and establishes the conditions and procedure for online submission, along with any related provisions issued in its implementation, shall also apply. Accordingly, where applicable, the company OUIGO will be responsible for making the payment on account or applying the relevant withholding under legislation on Personal Income Tax (hereinafter, “IRPF”).
In accordance with the aforementioned regulations, participants in this promotion are hereby informed that prizes awarded for participation in games, contests, raffles or random combinations linked to the sale or promotion of goods or services are subject to IRPF withholding or payment on account, provided the value of the prize exceeds 300 euros. For these purposes, it is stated that the market value of prizes in kind is equal to the acquisition value increased by twenty percent (20%), as established in Article 105.1 of Royal Decree 439/2007 of 30 March, which approves the IRPF Regulation.
OUIGO will cover the amount corresponding to the IRPF payment on account on the value of the prize. However, the winner must include both the value of the prize and the amount of the payment on account not passed on in their annual IRPF return. OUIGO advises the winner that, depending on their income level, including the value of the prize and the payment on account in their tax return may result in an increase in the amount of IRPF payable. OUIGO shall not, under any circumstances, be liable for any incorrect tax declaration made by the prize winner.
TWELVE. APPLICABLE LAW
These participation terms and conditions are governed by Spanish law. Any dispute, disagreement, issue or claim arising from the execution or interpretation of these terms and conditions shall be submitted to the courts of the Winner’s place of residence, with the parties expressly waiving any other jurisdiction that may apply.
