ONE. ORGANISING ENTITY, TIMEFRAME, TERRITORIAL SCOPE AND PARTICIPANTS
The trading company OUIGO ESPAÑA, S.A.U. (“OUIGO”), with registered office at Calle Alfonso XII no. 62, 28014 Madrid and tax ID (CIF) no. A-88269972 (hereinafter “OUIGO”), is a private company and the Spanish subsidiary of SNCF Voyageurs, one of the world’s leading passenger transport groups, mainly in the railway sector.
OUIGO entered the Spanish market as a high-speed train operator, aiming to popularise this mode of transport with a simple, high-quality, low-cost service.
Since launching on 10 May 2021, OUIGO has operated ten daily services linking Madrid Puerta de Atocha, Barcelona, Zaragoza and Tarragona, Madrid Chamartín–Clara Campoamor and Valencia Joaquín Sorolla and Alicante-Terminal, Albacete–Los Llanos and Madrid Chamartín–Clara Campoamor. The company added Valladolid and Segovia to its destinations on 19 April 2024, Cuenca from 1 June 2024 and Elche and Murcia from 5 September 2024. Furthermore, as of 16 January 2025, OUIGO has included Seville, Málaga and Córdoba in its network, bringing its total number of destinations to 15.
These routes are served by a fleet of 16 double-decker trains that OUIGO has introduced for the first time on Spain’s high-speed rail network.
OUIGO will launch a nationwide promotion in the form of a “competition” (hereinafter the “Competition”), under the provisional or final title of “OUIGO PRIDE 2025 SHORT FILMS”, during the promotional period specified below. It is open to all individuals over the age of 18 residing in Spain who meet the requirements outlined in these terms and conditions, whether film students or members of the general public interested in creating audiovisual content.
The purpose of this Competition is to promote the creation of film scripts that tell a story about LGBTQIA+ diversity, as well as their subsequent filming and première screening during Pride Week 2025, and to give visibility to their creators. The Competition will run from 12:00:00 on 31 March 2025 until 23:59:59 on 26 June 2025, inclusive.
OUIGO hereby states that participation in this Competition is entirely free of charge.
TWO. PURPOSE OF THE COMPETITION
The purpose of the Competition is to promote the creation of short audiovisual works submitted to the Competition, in order to support young Spanish film talent and raise the profile of the actors, based on a story about LGBTQIA+ diversity and its screening during Pride Week 2025.
THREE. PARTICIPANTS
All individuals over the age of 18 residing in Spain who satisfy the conditions set out in the first clause and also meet the additional requirements detailed in the following clause may take part in this Competition.
Persons who have an employment, collaboration or service contract with OUIGO may not participate in the Competition, nor may their relatives up to the third degree of consanguinity, or anyone with a close friendship or romantic relationship with OUIGO’s administrative or competition management staff, or with members of the appointed Jury, except for a possible professional or academic relationship. Legal entities and minors under 18 are also excluded from participating.
Furthermore, the following persons may not participate in the Competition: (i) those who carry out or have carried out transactions with legal entities or natural persons whose activities are clearly at odds with the principles of anti-corruption, business ethics, neutrality and, more generally, the values promoted by the SNCF Group; (ii) those who use or have used sponsorship, patronage or donations to conceal an undue advantage granted directly or indirectly; (iii) those who enter into or have entered into sponsorship, patronage or donation agreements where the arrangement may give rise to suspicions of questionable or unethical practices; (iv) those who fund or have funded legal entities or natural persons whose activities may be equated with electoral or political party financing.
By participating in this Competition, participants express their total opposition to any act that could be considered corruption or bribery of any kind and confirm that they comply and will continue to strictly comply with the applicable anti-corruption legislation at all times, as well as the SNCF RESEAU S.A. Code of Conduct (available at: https://www.sncf-reseau.com/medias-publics/2024-06/24_06_07_code_conduite_anglais_sdr_sc.pdf?VersionId=7LIIg852nxg.UK8DfrtTlzcMbCFZc0Lx).
Should any person excluded from participating be declared the winner, they will forfeit the prize, which will instead be awarded to the next eligible person designated as an alternate.
FOUR. REQUIREMENTS FOR PARTICIPATION
In addition to meeting the requirements set out in the preceding clauses, participants must comply with the following in order to be eligible to participate in the Competition:
1. Send an email expressing their interest in participating to cortometrajes@ouigo.es.
2. Complete the form sent by OUIGO in response to the initial application, ensuring all fields are completed correctly.
3. Scripts must focus on stories related to LGBTQIA+ diversity and be original and not previously released.
4. The story, or part of it, must be inspired by OUIGO trains or any of the destinations it serves (Barcelona, Madrid, Valencia, Tarragona, Zaragoza, Albacete, Alicante, Cuenca, Murcia, Elche, Valladolid, Segovia, Seville, Málaga and Córdoba).
5. OUIGO will provide the participants whose scripts are selected in Phase 1 with the necessary permits to record on board its trains if required by the script.
6. The short films and their scripts must not include any reference to or appearance of OUIGO’s competitors.
7. The script and resulting film must be suitable for all audiences, according to ICAA guidelines.
8. The short films must not exceed a maximum duration of four minutes under any circumstances, including the credits and branded intro.
9. The short films must be exclusively in Spanish.
FIVE. PARTICIPATION PROCESS; PHASES; JURY
PHASE 1: Participation confirmation and script submission
Those interested must send an email requesting participation to cortometrajes@ouigo.es and must fully complete the participation form sent by OUIGO, as provided for in Section 1 of the previous clause.
The submission period for scripts will begin at 12:00:00 on 31 March 2025 and end at 23:59:59 on 20 April 2025, inclusive.
Scripts must be submitted via email to cortometrajes@ouigo.es, attaching the following documentation:
● Script in PDF format, along with a short synopsis of no more than five lines.
● A declaration expressing acceptance of these terms and conditions, the text of which will be provided by OUIGO along with the participation form.
● Statement confirming authorship and exploitation rights over the script, the text of which will be provided by OUIGO along with the participation form.
● Completed form including the scriptwriter’s full name, ID, address, phone number and email. If known at the time of registration, team member details should also be included.
● Portfolio of previous work.
PHASE 2: Script selection
A Jury composed of the individuals referred to in Clause Six will be responsible for selecting up to ten finalist scripts from those submitted. The jury will be made up of renowned audiovisual professionals and two OUIGO representatives. OUIGO will automatically destroy all documents submitted by applicants who are not selected.
The names of the finalists and the titles of their scripts will be announced on the competition website (cortometrajes.ouigo.com) on 25 April 2025. Once the finalist scripts are announced, those selected will have a set period in which to record and edit their short films, with a final submission deadline of 13 June 2025 at 23:59:59, inclusive.
Details on this process are provided in the production (short film recording) section below.
Two versions of short films must be submitted via Google Drive to cortometrajes@ouigo.es in .mp4 format (1280 x 720px): (i) one version without subtitles and (ii) one version with Spanish subtitles. Each version must have a minimum file size of 500 MB.
PHASE 3: Gala
All finalist short films submitted within the deadline set out in Phase 2 will be screened during Pride Week 2025 on 26 June 2025 at a cinema in Madrid, which OUIGO will announce in due course. OUIGO reserves the right not to screen any of the short films produced for any reason, with this decision being final.
During this gala, the two winning short films will be announced. The first prize will be awarded by the Jury, and the second prize will be awarded through a public vote on the Easypromos voting platform from 16 June to 22 June 2025, inclusive, on which the selected short films will be made available. Each person may cast a single vote for the short film they believe deserves the award decided by the public vote.
The competition schedule is outlined below:
● Participation confirmation and script submission: from 31 March 2025 until 20 April 2025 at 23:59:59, inclusive.
● Announcement of selected scripts: 25 April 2025, via the competition website (cortometrajes.ouigo.com) OUIGO.
● Recording/editing and deadline for short film submissions: until 13 June 2025 at 23:59:59.
● Public vote: from 16 June 2025 until 22 June 2025, inclusive.
● Short film première and announcement of winners: 26 June 2025.
All questions and queries from participants may be sent to the competition email address (cortometrajes@ouigo.es), which may be used for queries from the date of the competition’s publication until 20 April 2025 at 23:59. The first round of responses will be published on 7 April 2025 before 14:00:00, with the second round of responses being published on 14 April 2025 before 14:00:00 on the competition website (cortometrajes.ouigo.com).
As for production (short film recording), for filming on board the train for short films of the selected scripts, if requested, each team member will be provided with a free OUIGO return ticket, up to a maximum of eight people per project. The duration of one return journey will be the time available for the team to complete the filming of the short film on board the train. Filming will take place during normal commercial services, when space for filming is available, typically on weekdays. Real passengers will be present who must not be filmed. Notwithstanding this, OUIGO may reserve a carriage for one or more teams for filming purposes. In any case, the team must work within the space provided by OUIGO and coordinate with other teams if necessary. Timetables are available on OUIGO’s website or app (www.ouigo.com/es/en). The provisional filming date on board is set for 13 May 2025. However, this date is not final and may be changed at OUIGO’s discretion. OUIGO only provides the opportunity to film inside its trains. OUIGO cannot provide filming permits for stations and platforms. Filming days, routes and schedules will be subject to availability depending on train occupancy. Participants are responsible for all the production costs related to their short films (camera, sound, cast, editing, etc.). For organisational or safety reasons, OUIGO may impose additional filming conditions, limitations or restrictions, which will be communicated to the participants in due course.
Each short film must include a branded intro at the beginning, which OUIGO will provide to the finalists.
In terms of promoting the winning short films, in addition to the theatrical première during Pride Week 2025, OUIGO will promote the winning short films through its own platforms, including on social media and its website.
Participation will only be deemed valid if all the requirements set out in these terms and conditions are met.
SIX. SELECTION, ANNOUNCEMENT OF WINNERS AND SELECTION CRITERIA
The Jury responsible for selecting up to ten finalist scripts is made of the following individuals:
● Federico Pareja, Commercial and Marketing Director at OUIGO.
● Pablo Santidrián, film director and scriptwriter.
● Inés Pintor, film director and scriptwriter.
● Alejandro Melero, playwright and author of essays and fiction.
● Ager Mendieta Diaz, Coordinator of LesGaiCineMad, International LGBTQIA+ Film Festival.
● Ariel Yborra, illustrator, graphic designer and coordinator of the trans group at COGAM.
Once the script submission period has ended, the Jury will evaluate all scripts submitted that have complied with the requirements of these legal terms and conditions, taking into account the artistic and technical quality of the final result and how effectively it reflects the values of LGBTQIA+ diversity and respect associated with Pride Week. The jury will also consider how the OUIGO brand is integrated into the story and will select the ten finalist scripts on 25 April 2025.
The aforementioned Jury will select the winning short film at the gala held on 26 June 2025, during Pride Week 2025, at the cinema in Madrid where the short films will be screened, applying the same criteria.
The second prize will be awarded through a public vote on the Easypromos voting platform from 16 June to 22 June 2025, inclusive, where the selected short films will be displayed.
There will also be a “best actor” award, chosen by the Jury and a nationally acclaimed actor.
SEVEN. PRIZES
The prizes for this competition are as follows:
1st PRIZE IN THE SHORT FILM CATEGORY: €4,000 and a €100 OUIGO travel voucher.
The winner of this prize will be chosen by the Jury.
2nd PRIZE IN THE SHORT FILM CATEGORY: €1,500 and a €100 OUIGO travel voucher.
The winner of this prize will be chosen through a public vote on the Easypromos platform.
3rd to 10th PRIZE IN THE SHORT FILM CATEGORY: €350 and a €100 OUIGO travel voucher. These prizes will be awarded to the finalists selected by the Jury during the “script selection” phase who do not win the 1st or 2nd short film prizes.
“BEST PERFORMANCE” PRIZE: a €100 discount voucher for travel with OUIGO. This prize will be awarded to a single actor or actress from one of the ten finalist short films. The winner of this prize will be chosen by the Jury and a nationally acclaimed actor.
In addition, the winning short film and the two short films that receive the most public votes will be screened at the 30th Edition of the LesGaiCineMad International LGBTQIA+ Film Festival (hereinafter the “Festival”), specifically during the opening and closing galas of the Festival, on 11 and 23 November 2025, respectively, as well as during special sessions throughout the Festival between 11 and 23 November 2025.
The winners will be announced at the gala to be held on 26 June 2025 in Madrid.
The full prize amounts will be paid by bank transfer to the account specified by each winner within 30 days of the announcement, after deducting any applicable tax withholdings, as set out in Clause Thirteen. The awarding of prizes is subject to all members of the winning team passing a compliance check, following the procedure established by OUIGO and in accordance with current regulations on the prevention of money laundering and financial offences. If any member of the winning team fails to pass the compliance check, they will forfeit the prize, which will instead be awarded to the next person or team that successfully passes the compliance check and has been designated as an alternate.
Notwithstanding the above, and due to force majeure beyond OUIGO’s control, OUIGO reserves the right to modify or replace the prize, for valid reasons, with one of similar value and characteristics, and to adapt it to any circumstances that may arise.
EIGHT. ACCEPTANCE OF THE COMPETITION TERMS AND CONDITIONS
Participation in this Competition entails the awareness, understanding and acceptance of these legal terms and conditions, as well as those governing participation. Anyone who does not accept them in full will be disqualified.
By participating in this Competition, participants expressly agree to comply with all the legal terms and conditions outlined, understanding that any breach will result in disqualification without recourse or compensation, and accept OUIGO’s decision as final in any matter arising from this Competition. The legal terms and conditions will be sent by email to any participant who requests them and are also available online at https://cortometrajes.ouigo.com/ in the “Participation Terms and Conditions” section.
OUIGO reserves the right to make any changes, clarifications or corrections to the Competition Terms and Conditions, or to suspend or extend the Competition at any time for reasons of force majeure or those beyond its control, and will always make any such changes public.
NINE. OUIGO’S IMAGE AND INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS REGARDING THE MATERIAL USED FOR PARTICIPATION
Participants guarantee that they will respect OUIGO’s brand image; in particular, they will not link or display any OUIGO brand element alongside or associated with vulgar, defamatory or morally inappropriate content, or anything that may damage OUIGO’s image in general.
Selected participants irrevocably assign to OUIGO, free of charge, for use in informational, advertising and promotional purposes—including the organisation and promotion of this Competition—worldwide and for the maximum legal term of protection, all assignable intellectual, industrial and image rights and related economic rights over the scripts and resulting audiovisual works. This includes, but is not limited to, the rights of public communication, reproduction, distribution and adaptation, for exploitation in any format or medium and by any system, method or form.
Under no circumstances may participants present the selected script or short film or any related materials (such as stills or excerpts) that reference or represent OUIGO’s image (including, but not limited to, its logos, branding, interior or exterior train images, etc.) at other competitions, festivals or events, or reproduce, distribute, publicly communicate or license them for use in other works, anywhere in the world, without prior written approval from OUIGO. Participants must also obtain OUIGO’s prior written authorisation to make any reference to OUIGO in the exploitation of the selected script, short film or any of its elements in any media.
Participants guarantee that they are the rightful authors of the submitted material, or that they have secured all necessary third-party rights to assign it as outlined in these Legal Terms and Conditions with sufficient scope. Accordingly, the participant represents and warrants that neither the content of the materials (scripts, audiovisual works, etc.) nor the documentation submitted to OUIGO during the Competition, nor OUIGO’s exercise of the granted intellectual and industrial property rights, will infringe any third-party rights or violate any trade secret or image rights of third parties. To this end, the participant shall be liable to OUIGO for the peaceful exercise of the assigned rights and declares that no commitments or obligations have been or will be made that would undermine OUIGO’s or any third party’s rights under these Legal Terms and Conditions.
To this end, the participant accepts liability in relation to OUIGO for any financial consequences arising from actions, claims or disputes resulting from a breach of these declarations and guarantees, without any limitation. OUIGO shall not be liable, except as required by applicable legislation, for any damage or harm resulting from the use, reproduction, distribution or public communication, or any other activity related to the material submitted by participants that is protected by third-party intellectual or industrial property rights, without the participant having obtained the necessary authorisation from the rightful owners for the given use or intended use.
This clause shall remain in force after the Competition has ended.
TEN. FORCE MAJEURE
OUIGO reserves the right to extend, modify, cancel or suspend this Competition, or take any necessary and reasonable measures, in the event of force majeure or causes beyond its control.
Should it be necessary to change the dates of the Competition, the date of winner selection and/or the date the prize is to be enjoyed, OUIGO will inform all participants via its social media profiles and the competition website (cortometrajes.ouigo.com).
In any case, OUIGO will not be required to compensate participants if any of the aforementioned causes arise or if the Competition is suspended or cancelled as required by law. Such a situation would be communicated to participants as soon as possible.
OUIGO reserves the right to take corrective action and take any reasonable measures to address issues that may arise during the Competition or the enjoyment of the prize to ensure the smooth running of the event.
ELEVEN. IMAGE RIGHTS
The winners of this competition authorise OUIGO to capture and reproduce their image and/or voice by any means (whether in still photographs or through audio and/or audiovisual recordings), and guarantee that they have obtained the necessary authorisation from the members of their team, in particular the actors appearing in the short film. On their behalf, they authorise OUIGO to capture and reproduce their image and/or voice by any means. This authorisation includes the capture, use, reproduction, distribution, publication, adaptation and public communication (as well as making available to the public) of their image and that of their team members (and/or their voice and name), and the use of their full names and those of their team members in their capacity as winners in any advertising and/or promotional activity related to this Competition, and in particular to the Festival, without entitling them to any remuneration, consideration or financial benefit, except for receipt of the prize awarded in accordance with these legal terms and conditions. This authorisation is granted worldwide, free of charge and for the maximum legal duration of the aforementioned rights.
Notwithstanding the above, OUIGO shall not be obliged to use the images, names and/or voices of the winner and their team members and may choose to use them partially, selecting photos, images and/or making edits and/or adaptations as it sees fit in each instance.
TWELVE. FRAUD
Should OUIGO or any entity professionally involved in this competition detect any irregularity or suspect that a participant is hindering the normal course of their participation in this Competition by illegally altering their registration or participation, using any technical or computer procedure to falsify their participation, it may unilaterally remove that participant from the competition without any notice.
To this end, it is important to mention that OUIGO has implemented the necessary technological systems to detect any fraudulent, irregular or malicious actions intended to influence participation in the competition in order to secure a prize unlawfully. Therefore, OUIGO reserves the right to remove from the register any participant who demonstrates or is suspected of such conduct, without any notice.
OUIGO also reserves the right to remove any user who defrauds, interferes with or impairs the smooth and regular running of this Competition.
Similarly, if fraudulent use of the Competition is detected, OUIGO may amend these legal terms and conditions where appropriate to ensure the smooth running of the event and will publicise such changes to the same extent as these legal terms and conditions.
THIRTEEN. TAX AND ANTI-CORRUPTION
The prizes awarded under this Competition are subject to any applicable tax obligations, which OUIGO will be responsible for paying in all cases.
By accepting their respective prizes, the winners declare that they are aware of and expressly accept the SNCF RESEAU S.A. Code of Conduct, and undertake to make use of the awarded prizes in accordance with the applicable basic behavioural principles and commitments, fully understanding that any breach will result in the obligation to return the full prize, with no right to claim or compensation, and will entitle OUIGO to claim damages from the winners.
In addition, the winners express their total opposition to any act that could be considered corruption or bribery of any kind and declare that they comply with and will continue to strictly comply with the applicable anti-corruption legislation.
By accepting their prizes, winners undertake to:
(i) Not authorise, offer, promise or give something of value in the name of or for the benefit of OUIGO to:
a) any Official , with the intention of improperly influencing any official act;
b) any other person, if they know or should know that all or part of the cash or item of value will be offered, promised or given to an Official to unlawfully influence any official act; or
c) any person in order to induce them to act improperly or dishonestly or reward them for improper conduct, or if the recipient has already acted improperly, for the mere fact of receiving something of value.
d) Not to receive or accept any payment, gift or other advantage that violates applicable anti-corruption regulations.
FOURTEEN. DATA PROTECTION
In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or “GDPR”), as well as Organic Law 3/2018 of 5 December on Data Protection and the Guarantee of Digital Rights (“LOPDGDD”), OUIGO ESPAÑA, S.A.U. informs participants that their data will be processed for the management and administration of this competition and, if applicable, for the delivery of prizes should they be declared winners.
The data controller is OUIGO ESPAÑA, S.A.U., with tax ID (CIF) A-88269972 and registered office at Calle Alfonso XII, 62, Madrid (hereinafter “OUIGO”). OUIGO has formally appointed a Data Protection Officer (DPO) who may be contacted at dpo@ouigo.es.
Identifying and contact details, data generated in the course of participation in the Competition, and, where applicable, image and personal details of third parties provided by participants in connection with the short film will be processed. Furthermore, if declared a winner, the necessary bank details will be collected to enable payment of the prize money, as outlined in Clause Seven. If a participant provides personal data of third parties, they guarantee that they have informed those individuals of the data processing described in this document and that they have obtained their consent or have another valid legal basis for disclosing this data to OUIGO. If special category data belonging to third parties is processed, participants guarantee that they have obtained the necessary consent from those third parties for the processing of their data in relation to this competition.
Participants declare and guarantee that all personal data provided to OUIGO is accurate and corresponds to their identity, and accept the publication of their name and the title of their script on the competition website (cortometrajes.ouigo.com) for the purpose of selecting the finalist scripts.
The processing of the aforementioned data has the consent given to OUIGO through voluntary participation in this Competition as its legal basis, and is carried out for the following purposes:
● To manage registration and participation in the Competition and to provide information so that participation complies with the provisions of the Legal Terms and Conditions governing the event.
● To manage the delivery of or facilitate access to and enjoyment of the prize awarded to the winners.
The collection of personal data is necessary for the purposes indicated above, and any objection by the participant will result in their inability to take part in the Competition.
Furthermore, the personal data provided may be processed in order to comply with OUIGO’s legal and/or tax obligations as the organiser of this Competition.
The personal data of participants and winners will be retained for the time necessary to validate participation and, in the case of winners, for the delivery of the prizes, as well as to comply with any applicable statute of limitations for legal obligations in tax or any other relevant matters. Once these purposes have been fulfilled, the data will be retained solely for the period required to enable OUIGO to exercise its right to defence should it pursue or be subject to any claim or liability arising from the Competition. This retention period will be the same as the limitation period of any actions or obligations that may arise between you and OUIGO.
Personal data may be disclosed to relevant public bodies in compliance with the legal obligations applicable to OUIGO (e.g. tax and accounting regulations) as well as to notaries. No international transfers of personal data are planned. However, if such a transfer becomes necessary, for example, to a service provider acting as a data processor, OUIGO will give priority to selecting a country that offers an adequate level of personal data protection or, failing that, will adopt additional safeguards to ensure the security of the personal data transferred, in accordance with the options recognised by current regulations, such as the signing of standard contractual clauses. You may obtain more information about international transfers and data processors by writing to dpo@ouigo.es.
You may exercise your rights to access, rectification, erasure, objection, portability and restriction of processing at any time, as provided for in the GDPR and LOPDGDD, by sending your request by email with the subject “Data protection” or in writing to the aforementioned address of OUIGO ESPAÑA, S.A.U., for the attention of dpo@ouigo.es. Likewise, participants may contact OUIGO’s DPO at dpo@ouigo.es.
OUIGO will provide the requested information within a maximum of one month from receipt of the request. This period may be extended by a further two months if necessary, depending on the complexity and number of requests.
Lastly, participants have the right to seek the protection of the Spanish Data Protection Agency (www.aepd.es) if they believe their data protection rights have been violated.
FIFTEEN. - LIABILITY OF THE ORGANISING COMPANY
OUIGO, as the Organising Company, reserves the right to shorten, extend, modify or cancel this Competition if exceptional circumstances arise that prevent it from taking place, and will communicate any such circumstances in a way that avoids any harm to participants.
Without limiting any rights granted to participants under applicable law, OUIGO shall not be held liable for delays, losses or damage to entries for reasons beyond its control. OUIGO shall not be held responsible for any force majeure events (such as strikes) that may prevent the winner from fully or partially enjoying the prize. OUIGO shall not be held liable in such cases, as well as regarding any liability for harm or damages that may arise during the enjoyment of the prize. OUIGO shall also not be liable for any interruption, temporary unavailability or failure of operation, transmission issues, data loss, fraud, network malfunction, software failure, access or communication errors or any alteration of the Competition due to technical or other issues beyond its control or attributable to network operators, intermediaries or third-party service providers.
OUIGO shall not be held liable for damages of any kind resulting from the temporary unavailability or failure of the Easypromos platform used to participate in the Competition, or from the inability of users to benefit from the Competition as expected.
OUIGO reserves the right to remove from the Competition, for justified reasons, any user who defrauds, alters or disrupts the smooth running and the normal and regular course of the Competition.
Participants in this Competition hold OUIGO harmless, to the fullest extent permitted by law and without waiving any of their rights as consumers, from any liability, penalty, claim, demand or legal action—civil, commercial, criminal or administrative—including any damages, costs or fees (expressly including legal and court representation fees).
Without limiting in any way the application of consumer guarantees and rights under applicable law, OUIGO shall not be liable for any negligent or unlawful use of the Prizes by participants and accepts no responsibility for any damages or harm suffered by winners or third parties as a result of the use of the prizes.
OUIGO shall not be held liable for any changes, modifications or cancellations of all or part of the prize due to force majeure or any other circumstances (such as weather conditions, etc.) that prevent the full or partial enjoyment of the prize. OUIGO reserves the right to take corrective action and take any reasonable measures to address issues that may arise during the Competition in order to ensure its smooth running.
Should a court or competent administrative authority rule that any provision of these Legal Terms and Conditions is invalid, illegal, void or unenforceable, the provision in question shall be removed without affecting the validity of the remaining provisions.
OUIGO will be held harmless from any liability from the moment the winner accepts and enjoys the prize. The winner waives any right to bring legal action against OUIGO regarding the use or enjoyment of the prize.
SIXTEEN. DISPUTE RESOLUTION AND APPLICABLE LAW
All participants expressly accept that any dispute or legal issue arising from the interpretation or application of these legal terms and conditions shall be subject to the jurisdiction of the courts of the city of Madrid, expressly waiving any other jurisdiction to which they may be entitled. These Terms and Conditions are governed by Spanish law.
