GENERAL CONDITIONS FOR PARTICIPATING IN THE “HAPPY LAPS” ACTION

1. Purpose of the Action


OUIGO ESPAÑA S.A.U. (hereinafter, “Ouigo”) organizes individual practical advice sessions for returning home for Christmas on board certain trains during the dates December 17, 18, 22, and 23, 2025 (hereinafter, the “Action”). The sessions, which will take place during the journeys indicated in the next section, will have an approximate maximum duration of 30 minutes and will be aimed exclusively at addressing emotional aspects related to returning home for Christmas.


The practical advice talk for returning home for Christmas offered on board is an informative action carried out by psychology professionals who are independent from OUIGO, participating solely as psychologists and communicators, offering general advice and guidelines related to emotional management and returning home, from a preventive and educational approach.


This is in no case therapy, psychological consultation, clinical advice, or healthcare service.


During the activity, no diagnosis, treatment, personalized clinical guidance, or follow-up will be performed. OUIGO only provides the physical space and necessary logistical coordination for the activity to take place onboard, without intervening in or influencing the content, recommendations, examples, or messages conveyed by the professionals.


In this regard, the participant acknowledges and accepts that:

  1. The activity is carried out independently by the psychologists, without OUIGO’s participation or responsibility with respect to its content.
  2. OUIGO does not control, supervise, validate, nor necessarily identify with the advice, opinions, or examples shared during the activity.
  3. OUIGO assumes no responsibility for any direct or indirect consequences arising from the interpretation or application of the advice by each participant.
  4. Attendance is voluntary, free, and based on the judgement and responsibility of the participant.


The advice given is of a general and informative nature and does not replace personalized consultation with a healthcare or mental health professional when needed.


2. Dates, routes and seat availability


The sessions will be offered only onboard the following trains:

  • December 17: MAD Atocha–BCN (10 :02h – train 06501, 2 sessions) and BCN–MAD (13 :50 – train 06540, 5 sessions).
  • December 18: MAD Chamartín –VAL (12 :15h – train 06822, 3 sessions) and VAL–MAD (15 :23 – train 06553, 3 sessions).
  • December 22: MAD Atocha–SEV (11 :10h – train 06410, 5 sessions) and SEV–MAD (15 :07 – train 06557, 5 sessions).
  • December 23: MAD Atocha –MAL (9 :55h – train 06508, 5 sessions) and MAL–MAD (13 :52 – train 06549, 5 sessions).


3. Location


The sessions will be conducted by duly qualified professionals in Coach 1, lower level, of the corresponding train, which will remain blocked and exclusively set up for this Action. Participants must arrive at Coach 1 of the train 5 minutes before the start of their session.


4. Participation requirements


Only persons who have a confirmed and valid ticket for the train, date, time, and indicated routes may register. Tickets with origin and/or destination at intermediate stops are excluded. In the case of the December 17 journeys, the ticket must be for travel in Coaches 1 to 8, since these are the ones from which Coach 1 can be accessed from inside the train.


Participants must be over 18 years of age on the date of the session.


The session reservation (date and time) will be made in order of registration through the website enabled for this purpose, without any raffle or discretionary selection of participants. The reservation is limited to one person per talk. OUIGO will determine which psychologist will attend each session.


Persons who are linked to OUIGO through an employment, collaboration, or service contract, as well as minors under 18 years old, may not participate in this Action.


5. Participation procedure


To participate in this Action, in addition to meeting the above requirements, it is necessary to comply with the following: Fill in the registration form that will be sent by email to the address of the persons who have purchased a ticket for a journey listed in section 2. This form will request the following data:

  • The participant’s first and last name, i.e., the person who will attend the session;
  • Selected time slot;
  • Date and route of the trip.


The requested data will be the minimum necessary to organize and guide the session, avoiding the collection of unnecessary sensitive information for the purpose of the Action.


Each person may only register for a single session, and only one passenger per booking may register. A participant’s registration will only be considered valid if all the requirements set out in these general conditions are met.


Booking a session on behalf of a third party implies acceptance of these general conditions on behalf and in the name of said third party.


6. Registration confirmation


OUIGO will contact the participant to confirm their registration through the email address associated with the booking.


7. Purpose and scope of the Action


The sessions are one-off and do not constitute ongoing psychotherapy treatment nor clinical intervention for serious mental health conditions. Their aim is to provide support and guidance exclusively on issues related to returning home for Christmas.


8. Cancellation


If the participant wishes to cancel their registration, they must notify the following email address: experience@ouigo.es , at least 24 hours before the travel date. OUIGO reserves the right to cancel the Action or any particular session. In case of cancellation, the session may not be held at another time. OUIGO will notify the registered participants as soon as possible via the email address associated with the booking.


9. Image rights


Participants in the Action authorize OUIGO to capture and reproduce their image by any means (whether by still photo or audiovisual recording), and authorize OUIGO to capture, reproduce, exploit, distribute, publish, transform, and publicly communicate (as well as make available to the public) their image and/or name, without this granting them any remuneration, consideration, or economic benefit, except for participating in the session under these general conditions.


This authorization is worldwide, free of charge, and valid for the maximum duration of the aforementioned rights.


Without prejudice to the above, OUIGO shall in no case be obliged to use the participant’s image and name, and may use them partially or not at all, selecting photographs, images, and/or making cuts and/or adaptations considered appropriate in each case.


10. Data protection


In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016 (General Data Protection Regulation – GDPR), and Organic Law 3/2018 of December 5, on Data Protection and Guarantee of Digital Rights (LOPDGDD), OUIGO ESPAÑA S.A.U. informs participants that their data will be processed for: i) the management and organization of the Action, and ii) commercial purposes as indicated in clause nine of these general conditions.


Any personal data that participants share with the psychologists during the Action will be under the sole responsibility of those professionals, who will act as independent controllers and will apply confidentiality, professional secrecy, and other obligations under the applicable regulations, including GDPR, LOPDGDD, and any other ethical and professional obligations. OUIGO will not access, process, or be responsible for such data in any case.


Participants declare and guarantee that any personal data they provide to OUIGO, if applicable, are true and correspond to their identity.


Data processing is legitimized based on the execution of the relationship derived from participation in the Action and consent for image use as indicated in clause nine.


Rights of access, rectification, erasure, objection, portability, and restriction of processing, as stated in GDPR and LOPDGDD, may be exercised by sending a request via email to datos@ouigo.es or by writing to OUIGO ESPAÑA S.A.U.’s above-mentioned address.
OUIGO will not transfer data to third parties except as legally required or to essential service providers for advertising dissemination, with appropriate guarantees.


Retention of participants’ data shall be for the time necessary to meet the statute of limitations for legal obligations in tax matters, if applicable.
Once these purposes are fulfilled, the data will be kept only for the time needed to allow OUIGO to exercise its right of defense in case of any claim. This period will be equivalent to the statute of limitations for actions and obligations arising from the relationship between participants and OUIGO.


11. OUIGO’s responsibility


OUIGO reserves the right to shorten, extend, modify, or cancel this Action if exceptional circumstances occur that prevent its realization, notifying participants as soon as possible.


OUIGO will not be responsible for delays, losses, or deterioration of any participation for reasons beyond its control, nor for force majeure (such as strikes, cancellation of train operations by ADIF, operator-imposed traffic restrictions, mobility restrictions at participants’ residences, etc.) or causes beyond its will that may prevent participation in the Action.


OUIGO is exempt from any liability if any of the above cases occur, as well as from liability for any damages that may be caused during participation in the Action.


OUIGO excludes any liability for damages of any kind that may be due to temporary unavailability or continuity of the website through which registration is made, telephone networks, or loss of usefulness that users may have attributed to it, and in particular (without limitation) failures in accessing the registration form for this Action.


Participants in the Action release OUIGO, to the fullest extent permitted by law, from any liability, sanction, claim, civil, commercial, criminal, or administrative cause, including any kind of compensation, expenses, or costs (expressly including attorney and court agent fees).


Without limiting the guarantees and rights recognised to consumers under applicable law, OUIGO will not be held responsible for participants’ involvement in the Action and assumes no liability for damages to participants or third parties resulting from participation in the Action.


OUIGO assumes no liability for changes, modifications, or deletion of all or part of the Action for reasons of force majeure or other circumstances (weather conditions, etc.) preventing its development. OUIGO reserves the right to take corrective measures and any reasonable decisions needed to resolve incidents arising during the course of the Action to ensure its proper development.


OUIGO shall be exempt from any liability as from the moment the participant registers to take part in the Action. The participant may not take any legal action against OUIGO for any reason arising from registration and/or participation in the Action.


12. Applicable law


All participants expressly accept that any dispute or litigation arising from the interpretation and application of these general conditions shall be submitted to the jurisdiction of the Courts of Madrid, expressly waiving their own jurisdiction if any. These conditions are governed by common Spanish law.


13. Acceptance of conditions


By registering for the Action, participants accept its general conditions. The participant in the session expressly releases OUIGO from any responsibility that may arise from their participation in the session.
