FIRST. – ORGANISING COMPANY, TIME FRAME, TERRITORIAL SCOPE AND PARTICIPANTS
The business organisation OUIGO ESPAÑA, S.A.U. (hereinafter, ‘OUIGO’), with registered office at C/Alfonso XII n° 62, 28014-Madrid and Tax ID No. A-88.269.972, will hold a nationwide promotion in the form of a “draw” called “Fitur 2026 Tickets” (hereinafter, the “Promotion”) during the promotional period specified below, open to all individuals over the age of 18 who are legally resident in Spain, via the OUIGO Instagram profile.
The Promotion will run from 12:00:00 on 15 January 2026, until 23:59:59 on 16 January 2026, inclusive, under the conditions detailed below.
Should it be necessary to modify, extend or repeat the Promotion for reasons beyond OUIGO's control, this will be made public via OUIGO's Instagram profile.
Participation in this Promotion is completely free of charge.
SECOND. – PURPOSE
The purpose of this Promotion is to raise awareness and increase the visibility of OUIGO among social media users, specifically Instagram users. OUIGO will hold a draw on its official Instagram account (@ouigo_es) for one (1) set of two tickets to attend the Fitur (International Tourism Fair) on Saturday, 24 January 2026, from 10:00 a.m. to 8:00 p.m., or on Sunday, 25 January 2026, from 10:00 a.m. to 6:00 p.m. (hereinafter, the “Event”), at the winner's discretion.
THIRD. – LEGITIMACY TO PARTICIPATE
All individuals over the age of 18, legally residing in Spain, registered Instagram users with a real user profile, and who follow OUIGO's official Instagram account are eligible to participate in the Promotion.
OUIGO employees and those of companies involved in conducting the Promotion, as well as their respective second-degree relatives, minors under the age of 18 and non-residents of the United Kingdom, are not eligible to participate in the Promotion.
If any individuals excluded from participation are selected as winners, they will forfeit their right to receive the prize, which will be awarded to the following eligible individual who meets the valid participation conditions and has been designated as a substitute.
FOURTH. – PARTICIPATION MECHANISM
To participate in this Promotion, in addition to meeting the above requirements, it is necessary to comply with the following:
● Participants must follow OUIGO's official Instagram account (@ouigo_es)), like the post announcing the Promotion, and tag another user (their travel companion).
Users may participate as many times as they wish, tagging different users in the comments. However, users may only win one prize. Participation by a person using multiple profiles is excluded. Doing so may result in the user's participation being excluded per these Terms and Conditions.
A user's participation will only be considered valid if all the requirements set out in these Terms and Conditions are met.
Comments featuring vulgar, defamatory, or otherwise offensive content, as well as content that is contrary to morality and good customs, will not be accepted. These will be automatically deleted from the comment thread of the post.
OUIGO shall not be liable for any incident that may interrupt Instagram service and thereby prevent participation in the Promotion. Furthermore, OUIGO will not provide data service connectivity, nor will it be responsible for any incidents involving operators that prevent participation.
FIFTH. - DRAW. NOTIFICATION OF WINNER AND DELIVERY OF THE PRIZE
The prize draw will be conducted using a random selection system via a platform that allows all participants who meet the above requirements to be included. The application, as mentioned earlier, provides a tool for randomly selecting the winners of the Promotion and issuing a certificate of validity that confirms the draw has been carried out through the application in a random manner. One (1) winner will be selected no later than January 20, 2026.
The winner will be chosen from a single set of entries, including users who have fulfilled the requirements outlined in these Terms and Conditions. The process of selection will be repeated until a single (1) valid winner is identified.
Similarly, up to four (4) substitutes will be selected to address potential withdrawals, non-compliance, or other issues involving the original winner.
Once the winner has been selected, OUIGO will contact them by direct message (DM) on its official Instagram account from 12:00 noon on 20 January 2026.
The winner must contact OUIGO via private message within twenty-four (24) hours of receiving notification to accept the prize and provide their contact details. If the winner has not complied with the above requirements within the specified period, the same procedure will be repeated with the substitutes, and the prize may, where appropriate, be declared void.
The winner must provide OUIGO, via this private message, with the required personal details (full name, email address, and any other information necessary for purchasing concert tickets and round-trip train tickets operated by OUIGO). OUIGO will then send the tickets for the Event in PDF format and, where applicable, book train tickets and send the travel documentation to the email address provided by the winner within one (1) day of the winner's acceptance of the prize. By providing the details of their travel companion, the winner declares that they have obtained their explicit consent to share this information with OUIGO, exclusively for the purpose of managing the delivery of the prize.
SIXTH. – PRIZES
The prize for this Promotion is as outlined below:
● One (1) set of two tickets to attend the Event (2 tickets in total) on Saturday, 24 January 2026, from 10:00 a.m. to 8:00 p.m., or on Sunday, 25 January 2026, from 10:00 a.m. to 6:00 p.m., at the winner's discretion, valid for the winner and one (1) travel companion of their choice.
- Tickets are valid only for the selected Event date and cannot be used, altered, or swapped for any other date.
If the winner and their travel companion are travelling to the Event from one of OUIGO's destinations that connects with Madrid, and they specifically request this from OUIGO, their transport will be included, subject to seat availability. Tickets will be for a round-trip operated by OUIGO for the winner and their travel companion. The outward journey will start from any OUIGO destination and end in Madrid. The return journey will start in Madrid and end at any OUIGO destination, on dates that match the day of the Event chosen by the winner.
Additional options (such as luggage, pets, etc.) are not included in train tickets, nor are they applicable to products ('packs' and similar) that include any option with the ticket.
Accommodation is not included under any circumstances.
Under no circumstances shall the prize be exchanged for its cash equivalent or another prize. The marketing and/or sale of the prize, whether direct or indirect, by any means, is prohibited.
SEVENTH. – FRAUD
In the event that OUIGO or any company professionally linked to this Promotion detects any anomaly or suspects that a participant is preventing the normal development of the Promotion, illegally altering their registration or participation by any technical or computerised means, or falsifying their involvement by any means, they may unilaterally remove said participant's registration. It is also important to note that the promoter has implemented the necessary technological safeguards to detect any potentially fraudulent, anomalous, or malicious actions intended to alter participation with the sole purpose of obtaining the prize illegally. As a result, the promoter reserves the right to remove from the register without prior notice any participant who exhibits or is suspected of inappropriate behaviour as outlined above. OUIGO reserves the right to justifiably remove any user who deceives, alters, or disrupts the proper functioning and normal, regulatory course of this Promotion. Similarly, if fraudulent use of the Contest is detected, OUIGO may amend the relevant provisions of these legal terms and conditions to ensure the proper functioning of the Contest, undertaking to give such amendments the same degree of publicity as these legal terms and conditions.
EIGHTH. – CLAIMS
The claim period for the Promotion ends one month after the end of the promotional period.
NINTH. – ACCEPTANCE OF TERMS AND CONDITIONS
By participating in the Promotion, participants accept its Terms and Conditions (available at https://www.ouigo.com/es/bases-legales-sorteo-fitur and OUIGO's criteria regarding the resolution of any issues related to the Promotion.
TENTH. – DATA PROCESSING
In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and the Council, dated 27 April 2016, on the protection of natural persons regarding the processing of personal data and the free movement of such data, which repeals Directive 95/46/EC (General Data Protection Regulation), as well as Organic Law 3/2018, dated 5 December, on Data Protection and Guarantee of Digital Rights (Organic Law on Personal Data Protection and Guarantee of Digital Rights), OUIGO ESPAÑA, S.A.U. informs participants that their personal data will be processed for the management and development of the Promotion as well as, where applicable, for collecting prizes if selected as winners.
Participants declare and guarantee that all personal data provided to OUIGO is true, accurate, current, and corresponds to their identity.
The processing of data is legitimised based on the promotional relationship established with OUIGO and is carried out by the latter for the purpose of managing registration and participation in the Promotion, as well as for delivering the prize in the event of a win. The collection of personal data is necessary for the purposes indicated above; therefore, any objection made at the participant's request would render it impossible to participate in the Promotion, as processing their data is a necessary contractual requirement.
At any time, participants may exercise their rights to access, rectification, erasure, objection, portability, and restriction of processing, as set out in the GDPR (EU) 216/679 and Organic Law on Personal Data Protection and Guarantee of Digital Rights, by sending their request via email to datos@ouigo.es or by writing to OUIGO at the address above.
The winners' data and, where applicable, their travel companion's details will be retained for the necessary duration of the validation process and the delivery of the prizes, as well as to comply with the limitation period for tax-related legal obligations.
Once these purposes have been fulfilled, the data will be kept exclusively for the period of time necessary to allow OUIGO to exercise its right of defence in the event that it claims or is claimed for any liability arising from your participation in the Promotion. This timeframe will be equivalent to the limitation period for any actions and obligations arising from the relationship between you, as the participant, and OUIGO.
ELEVENTH. – ADMINISTRATION OF THE PROMOTION VIA INSTAGRAM
Instagram does not sponsor, endorse, or administer this Promotion in any way, nor is it associated with it in any way. The information that users provide during their participation in the Promotion is provided under their own responsibility to OUIGO and not to Instagram. The information provided will be used in accordance with the provisions of these Terms and Conditions.
TWELFTH. – LIABILITY
OUIGO shall not be held liable for delays, losses, or damages resulting from causes beyond its control. organising company shall also not be liable for cases of force majeure (such as strikes, cancellation of services by ADIF, traffic restrictions, or limitations on the number of seats allocated to the rail operator, restrictions on personal mobility, or in the places of residence of participants, etc.), or for causes beyond its control that may prevent the winner from fully or partially enjoying their prize. The organising company shall be exempt from any liability should any of the above cases arise, as well as from any responsibility for damages that may occur during the enjoyment of the prize.
OUIGO excludes any liability for damages of any kind that may arise from the temporary unavailability or disruption of the social network through which users participate in the Promotion, telephone networks, or the disappointment of users' expectations regarding the Promotion. In particular, but not exclusively, to failures in accessing the various pages and participation responses sent through the social network of this Promotion.
OUIGO shall not be liable for any malfunctions of the electronic communication networks that hinder the proper conduct of the Promotion for reasons beyond OUIGO's control, mainly due to external acts of bad faith.
Nor shall OUIGO be responsible for transmission issues or data loss that cannot be attributed to OUIGO.
THIRTEENTH. – TAXATION
The prizes of the Promotion will be subject to Law 35/2006 dated 28 November, which approves the Income Tax for Individuals and partially modifies the laws on Corporate Income Tax, Income Tax for Non-Residents, and Wealth Tax; Royal Decree No. 2004/2009, which amends its regulations; Royal Decree No. 1003/2014, dated 5 December, and tax updates introduced by Royal Decree 633/2015, dated 10 July; the First and Third Transitory Provisions of Law 13/2011, dated 27 May, on the Regulation of Gambling; the first additional provision of Law 25/2009, dated 22 December 2009, which amends various laws to adapt them to the Law on free access to service activities and their exercise, and Article 48, section 6 and section 7, number 12 of Law 13/2011, dated 27 May 2011, on the Regulation of Gambling; Order EHA/388/2010 dated 19 February, which approves the tax on bets and random combinations, determines the self-assessment, the place and form of presentation, and establishes the conditions and procedure for its telematic presentation, along with other corresponding provisions issued in its development. Consequently, where applicable, the commercial organisation OUIGO shall be responsible for the payment or withholding of the Personal Income Tax (hereinafter referred to as PIT).
In accordance with the aforementioned regulations, participants in this promotion are informed that prizes awarded for participation in games, competitions, raffles, or random combinations related to the sale or promotion of goods or services are subject to withholding or advance payment of Personal Income Tax, provided that the value of the prize exceeds three hundred (300) euros.
To this effect, it is hereby stated that the market value for prizes in kind is equal to its acquisition value, increased by twenty per cent (20%), as established in article 105.1 of the aforementioned Royal Decree 439/2007, dated 30 March, which approves the Personal Income Tax (PIT) Regulations.
OUIGO shall be responsible for the amount corresponding to the withholding or advance payment of Personal Income Tax (PIT) relating to the value of the prize. However, it is the winner's responsibility to include both the value of the prize and the withheld or advance payment amount not charged in their annual Personal Income Tax (PIT) return.
OUIGO warns the winner that, depending on their income level, including the value of the prize and the withheld or advance payment amount in their tax return, could result in an increase in the amount they are required to pay for personal income tax.
Participants/winners are also informed that they must confirm their personal details on the day they are designated as such, providing their national identity card or a valid identification document in Spain.
OUIGO shall, under no circumstances, be liable for any incorrect tax return submitted by the prize winner.
Given that the prize offered in this Promotion consists of a set of two tickets and train tickets, with an approximate maximum value of €228 (corresponding to two tickets for two days at €14 per person, plus round-trip train tickets for two people at €100 per person), participants are hereby informed that they are not subject to withholding tax or Personal Income Tax (PIT).
FOURTEENTH. – APPLICABLE LEGISLATION
These terms and conditions for participation are governed by Spanish law. Any litigation, discrepancy, issue, or claim arising from the execution or interpretation of these terms and conditions shall be resolved by the courts and tribunals of the winner's registered address, to which the parties submit themselves, waiving any other jurisdiction to which they may be entitled.
FIFTEENTH. – CUSTODY OF TERMS AND CONDITIONS
The Terms and Conditions of this Promotion will be available to anyone who wishes to consult them at https://www.ouigo.com/es/bases-legales-sorteo-fitur.
